We practice exclusively in the Federal Bankruptcy Courts in the Southern, Eastern and Western Districts of Texas. We represent both debtors and creditors in Chapters 7, 11 & 13. Under the new Bankruptcy Laws, individuals are required to take a credit counseling course within the six months prior to filing a bankruptcy petition. This course may not be taken the same day as the bankruptcy petition is filed. A second debt management course must be taken after the creditor's meeting in order to receive a discharge in bankruptcy.

In order to qualify to file under Chapter 7, all individual debtors must pass a "means test". The means test is a measurement of income less allowed expenses as approved by the Internal Revenue Service. If the means test shows that an individual(s) has disposable income after all allowed expenses they do not qualify for a Chapter 7 bankruptcy and must file under Chapter 13 instead.
